Name: Virginia Freedom of Information Act

Citation: Code of Virginia § 2.2-3700

Commentary:

Only Virginia residents can file requests. Initial response time is five business days. There are no appeals. The Virginia Freedom of Information Advisory Council can help to resolve disputes. Fees can be charged for search/retrieval and duplication. Fee waivers aren’t addressed, but the law says that agencies “may” charge fees, which implies that they have the power to not charge. We’ve found that most educational institutions in Virginia charge exorbitant fees for animal records.
